Residential Sales Terms & Conditions

1. You will be liable to pay a ‘Fee’ to Dutch & Dutch (in addition to any other costs or charges previously agreed) if at any time unconditional contracts for the sale of ‘The Property’ are exchanged:

  • a) With any purchaser introduced by Dutch & Dutch or with whom we have had negotiations during a Sole, Joint, or Multiple Agency Agreement.
  • b) During a Sole or Joint Agency Agreement with any purchaser introduced by another agent.

2. The Fee payable is determined as a percentage of the eventual sale price as identified on the legal Sale Contract

3. The Fee will be due to Dutch & Dutch upon exchange of contracts and payable upon completion from the proceeds of the sale by your Solicitor

4. Fees will be subject to VAT at the prevailing rate, presently 20%

5. In some circumstances Dutch & Dutch may also act as Agents in the disposal of your purchaser’s property for which a fee may be earned

6. Dutch & Dutch may appoint Sub Agents to assist with the disposal of The Property, no additional Fees will be incurred by you and all viewings and negotiations will be co-ordinated by Dutch & Dutch

7. Our Agency continues from the date of this agreement until the expiry of the Notice Period, following notification in writing from you

8. A selection of advertising media will be utilised including marketing details, board, social media,,,, All additional advertising is at the discretion of Dutch & Dutch

9. During the period of a Sole or Joint Agency any approach made to you directly by a prospective purchaser or via another Agent are to be disclosed to Dutch & Dutch and the identity of the purchaser is to be provided

10. This agreement shall be governed by English Law and the parties submit to the exclusive jurisdiction of the English courts.
